Acceptance of Terms
These Terms of Service (the "Terms") govern your access to and use of AI Pin Maker, including our websites, applications, application programming interfaces, and all related tools and services (collectively, the "Service"). AI Pin Maker provides AI-powered image and video generation, badge and pin design, and AI photo album creation, together with the supporting account, subscription, and credit features described throughout these Terms. By creating an account, clicking to accept, purchasing a subscription, or otherwise accessing or using any part of the Service, you agree to be bound by these Terms and by any additional policies referenced in them. If you do not agree, you must not access or use the Service. You represent that you are at least the age of majority in your jurisdiction, or that you are using the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. If you are using the Service for or on behalf of a company or other organization, you represent that you have the authority to bind that entity to these Terms, and references to "you" include that entity. The Service is not directed to children, and you may not use it to create, request, or distribute content involving minors in any unlawful or otherwise inappropriate manner. These Terms form a binding agreement between you and AI Pin Maker. They incorporate any product-specific guidelines, acceptable use rules, and notices we publish from time to time. Where a translated version of these Terms is provided for convenience and a conflict arises, the meaning intended by the operative version we designate will govern to the extent permitted by applicable law. Your continued use of the Service following any update to these Terms constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically so that you understand the rights and obligations that apply to your use of the Service, including those relating to subscriptions, credits, intellectual property, and limitations of liability described in the sections below.
Use of the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable right to access and use the Service for your personal or, where you hold an applicable paid plan, commercial purposes. AI Pin Maker lets you generate images and videos, design badges and pins, and assemble AI photo albums using generative models and templates. You are responsible for all activity that occurs under your account and for ensuring that your use complies with these Terms and all applicable laws. You agree not to use the Service to create, upload, generate, or distribute content that is unlawful, infringing, defamatory, fraudulent, harassing, hateful, or that depicts or exploits minors in any unlawful or inappropriate way. You may not use the Service to violate the intellectual property, privacy, or other rights of any person; to generate content intended to deceive, impersonate, or harm others; or to produce material prohibited by applicable law. You must not attempt to reverse engineer, decompile, scrape, overload, or interfere with the Service or its underlying models, circumvent any usage limits or security measures, or resell or sublicense access to the Service except as expressly permitted. When you upload images, photographs, or other materials for processing, you confirm that you own those materials or otherwise have all rights and permissions necessary to use them with the Service, including the rights of any individuals depicted. You are solely responsible for the inputs you provide and for evaluating the suitability of any output before relying on or publishing it. Generative outputs may be imperfect, inaccurate, or similar to content produced for other users, and you should review outputs accordingly. We may establish reasonable technical and operational limits on the Service, including limits tied to your subscription tier and available credits. We may monitor use to maintain security, prevent abuse, and improve the Service, and we may suspend, restrict, or remove content or access that we reasonably believe violates these Terms or applicable law. We may also modify, suspend, or discontinue features of the Service at any time. While we strive for availability, the Service is provided on an "as available" basis and may experience interruptions, maintenance windows, or changes that affect functionality.
Accounts and Registration
To access most features of the Service, you must create an account and provide accurate, current, and complete information. You agree to keep your account information up to date and to maintain the confidentiality of your login credentials. You are responsible for all activities that occur under your account, whether or not authorized by you, and you must notify us promptly of any unauthorized access or suspected security breach. We are not liable for losses arising from your failure to safeguard your credentials. You may register only one account unless we expressly permit otherwise, and you may not share, sell, or transfer your account to another person. You must not create an account using false information, impersonate another individual or entity, or register on behalf of someone without authorization. We may refuse registration, reclaim usernames, or require additional verification at our discretion to protect the integrity and security of the Service. Your account is associated with the subscription plan and credit balance you select. You are responsible for ensuring that the contact and billing information linked to your account is accurate so that we can process payments, deliver service notices, and apply your monthly credit refresh and other entitlements correctly. Payments are processed through our third-party payment provider, Stripe, and your use of paid features is also subject to the applicable payment provider's terms. We do not store full payment card details ourselves; that information is handled by the payment provider in accordance with its policies. You may stop using the Service at any time and may close your account or cancel your subscription through the controls we provide or by contacting us. We may suspend or terminate your account if you breach these Terms, if required by law, or if we reasonably determine that your use poses a risk to the Service or to others. Upon termination, your right to access the Service will cease, and any provisions that by their nature should survive termination, including provisions on intellectual property, disclaimers, limitations of liability, and dispute resolution, will continue to apply. We may retain or delete account data in accordance with our policies and applicable law. Intellectual Property and Content Rights
As between you and AI Pin Maker, you retain all rights you hold in the original materials you upload to the Service, including photographs, images, and other inputs ("User Materials"). We do not claim ownership of your User Materials. By submitting User Materials, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, and transmit those materials solely as necessary to operate, provide, secure, and improve the Service and to deliver the outputs you request. This license exists only to enable us to run the Service and ends when your User Materials are deleted from our systems in the ordinary course, except for copies retained for backup, legal, or security purposes or as required by law. Subject to these Terms and your payment of any applicable fees, you receive rights to use the content generated through the Service ("Output") according to your subscription tier. If you hold an active paid plan, your use of Output includes a commercial-use license, and paid plans also provide entitlements such as high-definition downloads as described on our plans. Output produced under the free tier is licensed for your personal, non-commercial use only, subject to these Terms and any limits indicated for the free tier. Your rights in Output are conditioned on your continued compliance with these Terms; if your account is terminated for breach, the licenses granted for Output may be revoked to the extent permitted by law. Because generative models may produce similar results for different users, your rights in Output are non-exclusive, and we do not guarantee that any Output is unique or free of similarity to other content. You are solely responsible for ensuring that your User Materials and your use of Output comply with applicable law and third-party rights, and that you have obtained any consents required from individuals depicted. You must not use the Service to infringe intellectual property, generate unlawful content, or create content involving minors in an inappropriate manner. All rights in the Service itself, including the AI Pin Maker name, logos, software, user interface, underlying models and pipelines, and the design templates, presets, and other creative assets we provide, are owned by us or our licensors and are protected by intellectual property laws. Except for the limited rights expressly granted to you, we reserve all rights in the Service and its templates and brand assets. You may not copy, modify, distribute, or create derivative works from our proprietary materials except as expressly permitted by these Terms. If you provide feedback or suggestions, you grant us the right to use them without restriction or obligation to you.
Subscriptions, Credits, and Billing
The Service operates on a combined subscription and credit model. Subscriptions grant access to plan features and provide a recurring allocation of credits, while credits are the unit consumed when you generate images, videos, badges, albums, and other Output. Different actions may consume different amounts of credits depending on the model, output quality, and feature used. The credit cost of an action and the credit allocation of each plan are described in the Service and may be updated from time to time. By generating Output, you authorize the corresponding deduction of credits from your balance. Paid subscriptions renew automatically for successive billing periods unless cancelled before the renewal date, and your plan's credit allocation refreshes on a monthly basis in line with your subscription. Unless we state otherwise, refreshed credits replace rather than add to unused credits from prior periods, and credits do not represent money, store value, or constitute property. Credits are non-transferable and may not be sold, assigned, exchanged, or redeemed for cash, and they have no value outside the Service. We may adjust credit costs, allocations, and plan features prospectively, and we will make reasonable efforts to communicate material changes. All fees are charged through our payment provider, Stripe, in the currency and at the prices presented at the time of purchase, and you authorize us and our payment provider to charge your selected payment method for the subscription and any applicable taxes. You are responsible for keeping a valid payment method on file. If a charge fails, we may retry the charge, suspend access to paid features, or downgrade your plan in accordance with our and the payment provider's processes. Refunds, where available, are handled in accordance with applicable law and the procedures of our payment provider. Your statutory rights, including any non-waivable consumer rights in your jurisdiction, are not affected by these Terms. Where you believe you are entitled to a refund, you may contact us and we will assess the request consistent with applicable law and the payment provider's processes; chargebacks and disputes initiated through the payment provider are also subject to its procedures. Except as required by applicable law or expressly stated, fees already paid and credits already consumed are non-refundable. If you cancel a subscription, you generally retain access to paid features and any remaining credits for the period you have already paid for, after which your plan will not renew. Disclaimers and Limitation of Liability
The Service, including all models, templates, features, and any Output generated through it, is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, that Output will be accurate, reliable, original, or suitable for any particular purpose, or that defects will be corrected. Generative artificial intelligence has inherent limitations. Output may be inaccurate, incomplete, offensive, or similar to content produced for other users, and it may not reflect real persons, facts, or events. You are responsible for reviewing and evaluating Output before relying on it or making it public, and for ensuring that your use of the Service and any Output complies with applicable law and the rights of third parties. You assume all risk arising from your use of the Service and any Output, and from any User Materials you submit. To the maximum extent permitted by applicable law, in no event will AI Pin Maker, its affiliates, or their respective officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Service, whether based in contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the amounts you actually paid to us for the Service during a limited period preceding the event giving rise to the claim, or, where no amounts were paid, will be limited to the minimum extent permitted by law. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above exclusions and limitations may not apply to you; in such cases, our liability is limited to the greatest extent permitted by applicable law. You agree to indemnify and hold us harmless from claims arising out of your User Materials, your Output, or your breach of these Terms or applicable law, to the extent permitted by law.
Changes to These Terms
We may modify these Terms from time to time to reflect changes in the Service, our business practices, legal or regulatory requirements, or for other legitimate reasons. When we make changes, we will update the date or version associated with these Terms and, where the changes are material, we will take reasonable steps to notify you, such as by posting a notice within the Service, updating this page, or providing notice through another appropriate channel. It is your responsibility to review these Terms periodically so that you remain aware of any updates. Unless we state otherwise or applicable law requires a different approach, updates to these Terms become effective when posted or on the effective date we indicate. Your continued access to or use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may close your account or cancel your subscription using the controls we provide or by contacting us. We may also update related policies, product guidelines, plan descriptions, credit allocations, and pricing as described elsewhere in these Terms. Where a change materially reduces the rights or entitlements associated with a paid subscription you have already purchased for a current billing period, we will apply the change in a manner consistent with applicable law, which may include applying certain changes only from your next renewal. Changes do not apply retroactively to disputes that arose before the changes took effect, except to the extent permitted by applicable law. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be interpreted to achieve its intended purpose to the greatest extent permitted by law. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with the policies and guidelines referenced in them, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements on the same subject matter.
